Evidence of Defense Contractor Fraud: What the Government Was Told, What You Saw

Whistleblower Justice Network

The evidence needed for defense contractor fraud connects what the contractor told the government, the records that contradict it and the money it claimed. You may see hours moved to a job nobody worked, a supplier quote left out of negotiations, or a passing certificate for a test that failed. Your part of the business can explain a government bill that looks perfectly ordinary from outside.

What the Government Was Paying For

The contract and the payment request show what the government agreed to buy. When the company bills its costs, timecards and expense allocations affect the bill. When it negotiates a fixed price, the supplier information it discloses can affect that price before work begins.

Government money can also arrive before delivery. Progress-payment requests bill eligible costs as work proceeds, while performance-based payments depend on completing agreed milestones. Payments on delivery turn on whether the government accepts the goods as meeting the contract.

The same distinction reaches fees and money the contractor keeps. Performance-fee applications can be compared with original work requests, completion times and later software edits. Where supplier discounts belong to the government, discount records show what the contractor kept. We follow the particular charge, certification or retained payment with you, including who prepared it, who approved it and what they knew.

A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers. The starting evidence can sit in payroll, purchasing, engineering or security, wherever the company’s account of the work diverges from what an insider knows.

Finance Records Follow the Charge to the Bill

Documents proving defense contract cost mischarging connect the work performed to the job charged and the invoice submitted. Time sheets and payroll show hours and pay, while job codes and labor distributions show where the company assigned the cost. Contract requirements and employee qualifications answer another question: whether the person met the labor category billed.

In the CDI Corporation case, the government alleged that employees charged military aircraft-engine projects for work they had never performed on those projects. The Justice Department’s settlement announcement described false allocations in increments of half an hour or less under subcontracts with General Electric. In that allegation, the small entry was the mechanism. Someone familiar with the employee’s actual assignment could see what the charge code concealed, the central comparison in false labor billing.

Moving costs between jobs requires another comparison: the work’s original assignment against its destination in the accounts. In the AEPTEC Microsystems settlement, the government alleged that hours spent on commercial and other fixed-price work were charged to Navy cost-plus contracts. The alleged transfer moved the cost onto the Navy. The job history, contract terms and submitted charges explain that change together.

Indirect-cost pools can carry the same expense into another bill. The government alleged that Vector Planning and Services claimed direct costs, received payment, then included those costs in pools allocated across Navy contracts. Its settlement announcement describes the second payment the government said those entries produced. We follow the expense through the original charge, pool and reimbursement claim, because a companywide overhead total can conceal a very specific duplicate.

Pricing Analysts See What Negotiators Never Received

For a pricing analyst whistleblower, supplier cost data can connect the company’s internal calculation to the price presented to government negotiators. The useful comparison is between the dated supplier information available inside the business and the data disclosed before price agreement. Quotes, revisions, data requests, certifications and negotiation records each answer part of that question.

Lockheed Martin settled allegations that it withheld supplier cost or pricing data during negotiations for F-35 contracts. The government alleged that the information would have led to lower contract prices. The aircraft’s price had already absorbed the alleged omission before anyone delivered it. A pricing analyst could recognize the missing supplier fact while someone reviewing the eventual invoice saw only the agreed price.

The supplier’s identity matters too. An affiliate relationship or several distributor offers tracing back to one manufacturer can change what a price comparison actually compares. We examine the quote’s origin, the contract or modification being negotiated, the applicable data requirement and what was available at the time. A later purchase price and an earlier negotiation file belong to different dates, and those dates can decide what the contractor knew.

Quality Engineers See the Test Behind the Certificate

A quality engineer who sees false military test records may hold the evidence that makes a whistleblower case specific: the required specification, original result, affected lot and certificate. The production or lot identifier connects the laboratory’s work to the goods. Delivery and acceptance records then connect those goods to what the government bought.

Under its criminal deferred prosecution agreement, Bradken admitted that falsified tests concealed steel that failed Navy strength and toughness specifications and caused shipbuilders to bill the Navy as though the steel complied. The Justice Department’s account of the naval-parts case shows why the laboratory result mattered beyond the laboratory. The shipbuilder’s bill passed that false assurance to the Navy, which was paying for compliant steel.

Retests and sample labels can tell another part of the story. In its case involving Insect Shield, the government alleged that testing of Army uniforms combined different rounds, relabeled sample origins, used excessive retests and concealed failures. For an engineer, the original results, sample identity and testing sequence explain how the final report was produced. We connect that account to the specification, approval and government-facing claim.

Cyber Records Show Which System the Promise Covered

Cyber evidence connects the contracted system, assessment scope, reported safeguards and actual implementation. Security plans, access records and dated remediation work show what was operating when the company claimed compliance. The contract and the system boundary give those records their meaning.

MORSECORP settled civil cybersecurity allegations involving Army and Air Force contracts. In the settlement’s factual admissions, it acknowledged reporting an assessment score of 104 in January 2021, receiving a consultant’s assessment of -142 in July 2022 and leaving its reported score uncorrected until June 2023. A very different picture. We see the problem in the company’s own admissions: the reported score stayed in place even after the consultant found how far the safeguards fell short.

The whistleblower’s complaint alleged an instruction about what government personnel would see. It described security measures chosen for their visibility to visitors:

In response, Relator was instructed to implement only those cybersecurity measures that would be obvious to DoD personnel who remotely logged into Morse’s information systems, but to leave the majority of cybersecurity measures unimplemented.

United States ex rel. Berich v. MORSECORP Inc. et al., whistleblower complaint

We see the absurdity in that allegation: security for the customer’s screen, with most of the safeguards left undone. An IT or security employee’s account of that instruction can be connected to access settings, implementation records and what the company certified.

Source Certificates Follow the Part Through the Supply Chain

Source evidence follows the manufacturer, distributor and reseller to the component delivered. Purchase orders, manufacturer authorizations, traceability records and inspection results can connect a certificate to the goods it describes. For counterfeit parts, that includes the claimed identity of the product and who supplied it.

Domestic-origin certifications raise a related purchasing question. In the Raytheon Technologies case, the government alleged that goods manufactured in Romania were improperly certified as domestic, both in direct government sales and through a third-party supplier. The Defense Criminal Investigative Service, the Air Force Office of Special Investigations and the Naval Criminal Investigative Service investigated the case. We connect the actual manufacturing history to the sourcing requirement in the contract and the certification used for payment.

Purchasing Records Reveal Who Chose the Supplier

Vendor quotes, bid communications and benefits paid to purchasing employees can connect a supplier’s selection to the cost passed to the government. A buyer may know who created a supposed competing quote or why the chosen supplier kept receiving extensions. Finance may see the payment without seeing that decision.

In the KBR logistics case, the government alleged that employees rigged subcontract bidding in exchange for kickbacks and that KBR sought Army reimbursement for inflated costs. The Justice Department’s settlement account also described vehicle leases extended after internal records showed the equipment had been returned. Returned vehicles, continuing rent. In the government’s account, the return record and lease extension exposed a contradiction that the reimbursement voucher carried forward.

Ownership records can reveal who stands behind the supplier. Transparency International Defence and Security’s 2022 report Hidden Costs: US Private Military and Security Companies and the Risks of Corruption and Conflict identifies the opportunity created by obscure subcontracting:

Extensive supply chains provide corrupt contractors with opportunities to siphon off funds through obscure subcontractors.

Hidden Costs: US Private Military and Security Companies and the Risks of Corruption and Conflict, Transparency International Defence and Security, 2022

The report recommends connecting subcontractor ownership and registration to the services invoiced. For awards reserved for eligible businesses, the comparison also reaches who actually controlled, financed and performed the work when the company certified its status. We follow those relationships to the award and payments, where a name on a form meets the business operating behind it.

What Proof Do You Need as a Whistleblower?

You can speak with us about what you saw even if another department holds the contract or invoice. We distinguish your firsthand knowledge, what the records show and the connections still to establish.

The person who recognizes the contradiction can work outside the company billing the government. The Northrop Grumman satellite-parts case began with a whistleblower employed by The Aerospace Corporation. The National Reconnaissance Office’s inspector general investigated with other agencies, and the Justice Department joined the case, alleging failures to test and qualify microelectronic parts and misrepresentations about their reliability. Knowledge of the product crossed company boundaries.

An engineer’s test record and an accountant’s invoice can describe the same transaction from different ends. Your experience tells us which discrepancy deserves attention and who would understand the next record. If your concern involves classified or restricted records, our whistleblower experts and defense fraud whistleblower lawyers work through those considerations with you.

You Know Where the Story Changes

If you know why the timecard, supplier quote, test report or security assessment tells a different story from the government’s bill, speak with our whistleblower experts about that discrepancy. We work beside you to connect your knowledge to the government money and build your strongest defense contractor whistleblower case. We bring in defense fraud whistleblower lawyers with the expertise your evidence calls for and stay with you through the case.
