Air Force Bid-Rigging Plea: Direct Instructions for Rival Prices

Whistleblower Justice Network

An Air Force bid-rigging plea on June 2, 2026 exposed a shelving and storage distributor employee’s agreement with other bidders to exchange prices and sometimes tell each other exactly what to quote. The Justice Department’s account of the criminal information and plea agreement describes collusive bids for healthcare facilities at Moody and aircraft maintenance facilities at Nellis. If you handled a quote whose price came from a supposed competitor, you may recognize the problem before anyone opens the bids. The rival has helped write the offer it is supposed to beat.

The Price Was Chosen Before the Bid Was Submitted

In the plea agreement, as described by the Justice Department, the former employee admitted exchanging pricing information with other bidders before submitting bids. At times, they instructed each other on the exact price for particular projects. He pleaded guilty to conspiring to rig bids and to defraud the United States.

That sequence is the heart of defense procurement bid rigging. A buyer comparing the resulting offers sees prices attributed to separate sellers. The communication behind those offers shows the sellers coordinating the comparison itself. We see the absurdity: the supposed competition includes instructions from the competition.

Moody Healthcare and Nellis Aircraft Maintenance

The projects covered healthcare facilities at Moody Air Force Base in Valdosta, Georgia, and aircraft maintenance facilities at Nellis Air Force Base in Las Vegas, Nevada. The Antitrust Division’s case overview identifies the defendant as a former employee of a shelving and storage distributor located in Salt Lake City, Utah.

The projects had a total value of more than $1.8 million and received funding through the Defense Logistics Agency’s Facilities Maintenance, Repair, and Operations Program. The purchases were for shelving and storage products serving healthcare and operations facilities.

A reference to a healthcare project, a maintenance facility or a storage purchase can connect a conversation inside a distributor to a specific military procurement. For an employee who handled those offers, the product and destination may make a particular exchange recognizable in a way that a companywide sales total never would.

The Justice Department described this as the second plea in the military-facilities investigation. The Antitrust Division’s Washington Criminal Section, Air Force Office of Special Investigations, Defense Criminal Investigative Service and Defense Logistics Agency Office of Inspector General investigated the case.

The Quote’s Origin Matters Beyond the Prime Contractor

A distributor can supply a government contractor without holding the government’s main contract. In defense purchasing, the prime contracts directly with the government, while subcontractors supply the prime or another subcontractor. The federal purchasing definition of a subcontractor expressly includes suppliers, distributors and vendors.

That structure makes the source of a quote consequential before it reaches the government. When an offer passes through another business, we want to know both who presented it and who chose its price. A distributor employee may have seen the pricing instruction even when the buyer later sees only the finished offer. The employee’s account can connect the apparent seller to the person actually directing the number.

Transparency International Defence and Security examined private military and security companies in its 2022 report Hidden Costs. It found uneven government oversight and called for disclosure of subcontractors, including those further down the contracting chain. Its recommendation puts the information at the payment stage:

A buyer may see the prime’s invoice while a distributor employee knows where a competing price came from. Connecting those views can reveal the agreement behind an offer and the government purchase it sought.

What Are the Red Flags in Procurement Fraud?

A supposed rival telling your business exactly what price to quote is a concrete red flag in procurement fraud. In this plea, the criminal documents described both shared pricing information and exact-price instructions before the bids went in.

The pricing communications and submitted quotes answer different questions. The communication can show who supplied the number and why. The quote shows the offer presented in the seller’s name. The project, award and payment records connect that offer to the purchase the government funded.

If you prepared the quote, you may know why its price changed or whose instruction determined the final number. If you handled the purchasing side, you may know which offers were presented together for the same work. We work through those details with you, connecting the conversation you saw to the bid the buyer received.

When Coordinated Quotes Reached a Civil Settlement

Coordinated defense bids also appear in civil False Claims Act cases. In July 2025, Berg Companies agreed to a $3.3 million settlement over alleged bid rigging on defense contracts. The government alleged that Berg coordinated inflated shelter quotes so other sellers would win at inflated prices.

The alleged rival quotes gave the buyer a comparison whose prices had already been coordinated. The source of an apparently competing price can explain why the bidding failed to deliver independent competition. A losing offer can help the arrangement succeed.

Berg’s settlement announcement identified whistleblowers with experience as a company managing director and a former salesperson who was also a veteran. Their commercial roles matter to the reader handling bids now. Someone who understands how offers are produced can recognize the difference between the company’s pricing work and a price supplied to serve another bidder.

For a defense contractor whistleblower case, we connect that inside knowledge to the government purchase and the money involved. A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers. The civil opportunity begins with what you can explain about the arrangement and the bids it affected.
