Schuylkill Products: The Business Behind Marikina’s DBE Identity

Whistleblower Justice Network

Schuylkill Products and CDS Engineers were operating the business behind Marikina’s DBE identity across more than $136 million in over 300 contracts, according to the Department of Transportation Office of Inspector General’s report of a criminal conviction in 2012. They performed the concrete bridge-beam work while Marikina Construction appeared as the disadvantaged business enterprise. This DBE fraud reached from the stationery and email staff used to the removable signs on their vehicles. Someone who knew the crew could see something the company name concealed.

Who Did the Bridge-Beam Work?

Schuylkill Products and CDS Engineers performed the work attributed to Marikina. The Inspector General’s conviction report describes contracts from 1993 through 2008. Marikina’s name was on the jobs. Schuylkill Products and CDS Engineers did them.

For an insider, that distinction brings the story back to familiar ground. Who employed the people on the project? Who managed them? Whose equipment did they use? The case points toward the operating business behind the paperwork, where those answers can be compared with the company presented to the customer.

We see the unfairness to genuine disadvantaged businesses: participation loses its meaning when another business does the work under their category. Taxpayers are funding a promise of participation that the company name alone cannot deliver.

Marikina’s Name Reached the Email and the Vehicles

Staff used Marikina stationery, email, signature stamps and removable vehicle signs, the Office of Inspector General’s conviction report says. The identity appeared both in business communications and at the worksite.

We see the absurdity in that arrangement: a removable sign could change the company a vehicle appeared to represent without changing the business doing the work. The name moved. The operation stayed put.

The same report records earlier guilty pleas by participants in the scheme. The disguise reached the tools staff used to speak and appear as another business. For someone who worked alongside them, the name on a message and the person behind it could tell different stories.

The Work Behind a Commercially Useful Function

For work such as Marikina’s bridge-beam contracts, a commercially useful function means the disadvantaged business actually performs, manages and supervises its work. In transportation purchasing, that also reaches who negotiates prices, orders and pays for materials, and takes responsibility for them.

For the bridge-beam work, the revealing comparison is between the company credited with participation and the people carrying out the job. Someone in estimating may know who priced the work. Someone in purchasing may know who took responsibility for the materials. Someone on the project may know who directed the crew. Those are decisions inside a working business, beyond the name on a subcontract.

The Records Behind the Company Name

Contract and billing evidence connects the business presented to the customer with the actual performer and the payment. We work with you to connect bids, email authorship, payroll, equipment and management records, and subcontract payments to what happened on the job.

The Marikina details make the email question especially concrete. The account name says one thing. The identity and employer of the person using it may explain something else. The reader who recognizes that person brings knowledge a message alone cannot supply.

You may know the people behind the signatures without handling invoices, or understand the payment flow without working at the site. Our job is to connect what you know to the government-funded work it affected. Office staff and project staff may see different parts of the same arrangement. We bring those views together with you, so the case explains who ran the business behind the name.

A Complete File Can Still Conceal the Operator

Formal controls can coexist with fraud carried out by people able to override them. The 2019 study Unique Characteristics of Management Override Fraud Cases, published in the Journal of Forensic and Investigative Accounting, compared fraud involving overridden controls with fraud involving a lack of controls. Among those fraud cases, stronger anti-fraud arrangements were more closely associated with people overriding controls than with controls being absent.

The paper puts the limit of those arrangements plainly:

Thus, organizations having strong anti-fraud environments have not necessarily prevented fraud.

A file can present the expected company identity while the people using its email, stamps and signs tell a different story. That is why we look at how the business operates alongside what its paperwork says. The person who knows the work can help explain the gap.

The Same Staff Disguise in a Civil DBE Case

In its civil settlement, Spectrum Painting admitted that its personnel identified themselves as Tower Maintenance personnel, a staff disguise like the one behind Marikina’s DBE identity.

The Whistleblower’s Stake in the Recovery

A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers. If you recognize a DBE front, we assess with you how your knowledge could support a qui tam case and a government procurement whistleblower reward. We connect whose identity was used, who performed the work and how the arrangement reached government money.

You Know the Business Behind the Name

If the crew, correspondence or payment records show a different business from the DBE presented on the project, tell our whistleblower experts what you saw. We work beside you to build your strongest DBE fraud whistleblower case around those operating facts and bring in government procurement whistleblower lawyers who understand DBE fronts. From the first conversation through the case, you have a partner who understands why the name on the paperwork is only the beginning.
