DOE Furniture Coordinator: Her Husband Supplied the Winning Quote and the Competition

Whistleblower Justice Network

A federal furniture coordinator pleaded guilty to criminal conflict of interest over DOE furniture purchases and an undisclosed spouse’s interest. She admitted obtaining higher competing quotations from her husband and passing them to a co-worker. His original quote became the lowest, and he earned commissions when the government bought the furniture. The person benefiting from the winning quote had also supplied the apparent competition.

The employee coordinated office-space use and renovation for the Department of Energy, including furniture purchases for its Maryland campus and Washington headquarters.

How the Higher Competing Quotes Worked

The additional quotations came from the same person whose original quotation they were supposed to compete against. According to the court documents described in the Justice Department’s criminal plea announcement, the coordinator oversaw the renovation of a lobby and conference room in Germantown, Maryland, in 2006. That assignment included acquiring new furniture.

She recommended that a co-worker obtain furniture prices from her husband. The original quotations clearly identified him as the manufacturer’s representative. When the co-worker tried to purchase the furniture, she learned that each transaction required two additional price quotes from other companies to satisfy competitive bidding requirements.

The co-worker brought that requirement back to the coordinator. The coordinator admitted obtaining the additional quotes from her husband and giving them to the co-worker as the competitive quotations. She knew that, unlike the originals, none of the additional quotes named him. Each quoted a higher price, leaving his original bid the lowest. The Department of Energy bought the furniture using that original quotation.

The husband earned approximately $3,791 in commissions from the manufacturers.

We see the absurdity in that sequence: the request for competition went straight back to the person who stood to earn the commission. More paperwork. The same source.

This is the practical problem behind higher cover bids in government purchasing. Here, who supplied the prices explains how the apparent advantage was arranged. Taxpayers needed independent prices, and honest dealers needed an actual chance to compete.

The Cafeteria Purchase Paid Commissions Too

The later cafeteria project connected the employee’s furniture selections to commissions through a different purchasing arrangement. The court documents summarized in the criminal plea announcement describe an April 2008 assignment to oversee renovation of the Department of Energy’s Washington headquarters cafeteria.

The coordinator selected approximately $300,000 in furniture during April and May, and the manufacturers paid her husband approximately $24,174 in commissions. She admitted knowing that their representatives planned to use him as the dealer of record for those transactions. In May and June, she arranged for the General Services Administration to purchase the furniture on the Department of Energy’s behalf.

An insider’s view of the selection matters alongside the final order. The coordinator knew about the planned dealer arrangement while choosing the furniture, before she arranged the GSA purchases.

The Financial Disclosure Left Out the Commissions

The coordinator omitted her husband’s commissions from her confidential financial disclosure. The Justice Department’s criminal plea announcement says she signed and submitted the report on September 25, 2008, leaving out those commissions and any other reportable sources of income for him.

The spouse’s account later conflicted with the payments too. According to his plea agreement, as described in the same announcement, federal agents asked him about compensation from the cafeteria renovation. He admitted falsely telling them that he had tried to get business from the project but received no compensation.

The U.S. Attorney’s Office for the District of Maryland and the Justice Department’s Criminal Division, Public Integrity Section, prosecuted the case. The Department of Energy and the GSA Office of Inspector General, Office of Investigations, joined in announcing the pleas.

What Are the Indicators of Government Procurement Fraud?

In this case, the indicators were higher competing quotes supplied by the intended beneficiary, his name missing from those quotes, and commissions omitted from the employee’s disclosure.

A manufacturer, dealer or purchasing employee may recognize the relationship before an outside reviewer does. A reviewer can see different prices on separate documents. Someone who handled the quotations can explain where they actually came from, who requested them and who expected to be paid when the order went through.

What Proof Do You Need as a Whistleblower?

For a purchase involving a concealed spouse’s interest, the connection between the purchasing decisions and the payments matters. We build that account with the person who saw it.

The purchase and payment records show part of the transaction. In this case, the manufacturers’ commissions add another payment to examine: who benefited from the government purchase.

An invoice alone would not explain why the coordinator obtained the higher quotes or selected furniture that would earn her husband a commission. We work with the person who understands those decisions to connect the government’s spending with the interest behind it.

Why Independent Review Needs the Financial Relationship

More quotations did not mean independent competition in this case. Transparency International’s 2024 paper Transparency, Accountability, and Integrity of Public Procurement Systems identifies financial-interest disclosure as a procurement-integrity safeguard. It also discusses independent evaluators and review of critical decisions by multiple people.

The co-worker asked for more quotations and received them. We see the problem: review cannot test competition when the quotes hide their common source. Independence has to reach the information being reviewed.

The paper also puts suppliers on the receiving end of corruption:

Businesses can be both the perpetrator and victim of corruption in public procurement.

Transparency, Accountability, and Integrity of Public Procurement Systems, Transparency International, 2024

It describes the choice suppliers face between competing fairly and joining arrangements with other companies or officials, and links corruption and collusion to higher costs and reduced value for taxpayers.

A Spouse-Owned Supplier in Another Department of Energy Case

CH2M Hill Hanford Group agreed to a $1.5 million civil settlement over allegations involving Department of Energy purchases routed to spouse-owned companies. The government alleged that purchasing employees directed business to those companies for marked-up or nonexistent goods, after repeated internal audits had flagged weaknesses in purchase-card controls.

That case puts the family connection in the supplier and payment path. The furniture coordinator’s case puts it in the source of the competing quotes and the planned dealer commissions. In each, the useful insider knowledge concerns who stood behind an apparently ordinary purchase and who benefited from it.
