Government Procurement Fraud FAQ: Questions From Contractors and Insiders

Whistleblower Justice Network

Government procurement fraud questions and answers begin with a concrete comparison: the price, labor, product or eligible business the government paid for against what it actually got. A payroll employee may know the hours were invented. A subcontractor may know who really did the work. A sales manager may know which discounts never reached the government. That knowledge can connect an ordinary business record to a false claim for public money.

What Is Government Procurement Fraud?

Government procurement fraud is deception in publicly funded buying, including false billing, false certifications and manufactured competition. It changes who wins the contract, what the government pays or whether money owed to the government comes back.

The purchase creates a trail from solicitation and bid through contract, performance, invoice, acceptance and payment. We look for where the contractor’s account parts company with the work, goods or money behind it.

Who Can Commit Government Procurement Fraud?

Manufacturers, prime contractors, subcontractors and officials can each control a different part of the transaction. A manufacturer may supply false pricing data to a reseller. A prime may conceal the company performing the work. An official may steer an award or approve an inflated change.

Why Are Procurement Departments Particularly Vulnerable to Fraud?

The buyer often relies on facts the seller controls: commercial discounts, manufacturing origin, employee qualifications and subcontract costs. The receiving office can see that equipment arrived while the sales department knows the price disclosure was false. An insider connects those separate views.

What Are the Different Types of Government Procurement Fraud?

Government procurement fraud schemes include hidden discounts, false origin certificates, inflated labor charges, substituted goods, false small-business eligibility, kickbacks and rigged bids. They reach different parts of the purchase, so the useful evidence changes with the scheme.

With labor fraud, the question may be whether the hours were worked, whether staff had the billed qualifications or whether payroll described the work correctly. With product substitution, it is whether the delivered goods meet the specification. An altered test certificate can conceal the answer.

Kickbacks buy favorable treatment in a subcontract or recommendation. Bribery buys an official decision. A hidden financial interest can compromise the independent advice the government purchased. Following the benefit helps explain why a particular vendor, product or change was approved.

How Does the Civil False Claims Act Affect Government Procurement Fraud?

The False Claims Act reaches knowingly false claims for government money, false records that matter to payment and knowing avoidance of money owed back. It can also reach a supplier’s false representation used in a prime contractor’s claim.

False certification connects the promise to the payment: what the company represented, why it mattered and what it knew. An internal warning and the decision that followed can be central to that account.

What Is a False Certification?

A false certification misstates a fact the purchase depends on, such as where a product was made, who controls an eligible business or whether the billed staff meet the contract’s qualifications. The contract identifies the promise being tested.

Buy American requirements can turn on U.S. manufacture and component costs. Trade Agreements Act origin can turn on whether processing substantially transformed the goods into a new article. Factory and production records explain what happened behind the certificate.

The same comparison matters for cybersecurity representations: the promised requirement, the system or service actually supplied and what the contractor knew about the gap.

What Is GSA Fraud?

GSA fraud involves concealed commercial discounts, false country-of-origin claims, inaccurate sales reports or unpaid Industrial Funding Fees. The General Services Administration can receive the product and still be cheated on the price.

The Justice Department alleged that Oracle gave incomplete commercial-sales information and failed to pass on later discounts required by its contract. Oracle agreed to a $199.5 million settlement. The alleged deception sat in the pricing history behind the software sale.

Traditional Schedule pricing tied government prices to a negotiated comparison with commercial customers. Under Transactional Data Reporting, that pricing promise changes, while sales reports and fees remain. We check which terms governed the sale.

What Are the Indicators of Government Procurement Fraud?

Government procurement fraud red flags include a timecard that conflicts with the work performed, a passing certificate that conflicts with the original test output, or a small business’s bid written by the company actually doing the work. The contradiction becomes useful when it connects to a particular order, representation and payment.

The pricing model tells us where to look. Fixed-price purchases turn attention to deliverables, acceptance and authorized changes. Cost-reimbursement purchases bring cost ledgers, allocations, rebates and credits into view. Time-and-materials purchases make hours, qualifications, rates and materials central.

What Proof Do You Need as a Whistleblower?

Useful government procurement fraud evidence connects the contract’s promise to the contemporaneous record that contradicts it and the charge the government paid. Dates, witnesses and the instruction behind a changed record help explain who knew what.

We work through that purchase with you, including the records you already hold and how they relate to the claim.

Can Real Work Still Be Billed to the Wrong Federal Award?

Yes. The question is which work the award funded and which work was charged to it. In a federal research-grant case, a whistleblower alleged that The Scripps Research Institute charged existing grants for time spent preparing new grant applications. The complaint described the effort-report form:

The second page of the effort report listed the employee ID number, various Account Numbers and Hours associated with those Account Numbers and Total Hours of 160. The 160 hours was always already printed on the form.

U.S. ex rel. Burris v. The Scripps Research Institute, whistleblower complaint, paragraph 104.

The complaint alleged that account codes and preprinted hours obscured the distinction between funded research and other activity. We want to know how the work became the charge. A completed form can conceal that story as readily as an empty one.

Can Unpaid Subcontractors Reveal a False Claim?

Yes. A construction progress-payment certificate can state that amounts due to subcontractors and suppliers from earlier government payments have been paid. The subcontractor’s ledger and payment dates can contradict what the prime certified to obtain the next payment.

That gives the unpaid subcontractor a specific connection to the government’s money: the certificate, the previous payment and the amount still owed.

How to Prevent Government Procurement Fraud Within Your Organization?

The cases point to independent comparisons: original test results against certificates, actual work against timecards, and subcontract payments against claimed participation. If you see the contradiction behind an approved charge, we can assess what it means for a whistleblower case.

What Is Small Business Fraud?

Small-business set-aside fraud uses false ownership, control, affiliation or performance claims to obtain reserved contracts. A paper owner or eligible name can conceal the business that prices the bid, directs the work and keeps the proceeds.

TriMark admitted conduct that caused agencies to award contracts in violation of small-business and service-disabled-veteran rules. Its staff identified bids, supplied prices, ghostwrote emails and used small-business email accounts while TriMark performed substantially all the work. Civilian customers included Department of Veterans Affairs medical centers and the Bureau of Prisons. The Justice Department’s account makes the mismatch concrete: the eligible firm billed for a business another company ran.

In the separate Paragon Systems case, the government alleged that former executives used figurehead owners to obtain security contracts for the Department of Homeland Security, subcontracted substantially all the work to Paragon and concealed payments as consulting fees. Paragon agreed to pay $52 million to resolve those allegations.

Contracts reserved for smaller businesses. Another sales channel for the larger operator.

What Are the Rules for Small Business Set Asides?

Each program has its own size, ownership and performance rules. Ordinary small-business awards, HUBZone, women-owned and service-disabled-veteran programs carry distinct requirements. Bid preparation, management and payment records show who actually operated the business.

What Is 8a Set-Aside?

The 8(a) program supports government contracting by eligible socially and economically disadvantaged small businesses. Hidden control matters when another company uses the qualifying firm to obtain the work.

In the criminal case against a former MCC Construction officer, court documents described false statements to the Small Business Administration about MCC’s relationship with an eligible company. Those documents describe a General Services Administration contracting officer’s challenge to the firm’s small-business status. The former MCC officer pleaded guilty to conspiring to obstruct the agency proceeding. The correspondence explaining the relationship mattered alongside the bid itself.

Can an Eligible Small Business Prime Subcontract Work to a Large Business?

Subcontracting limits cap payments passed to large businesses, with different rules by purchase category. We examine the prime award, subcontract terms, actual performer and payment flow together.

What Are the Penalties for Misrepresenting HUBZone Status?

False HUBZone representations can lead to civil recoveries. CFP Group and its president agreed to pay $150,000 to resolve allegations that the company obtained a VA fire-alarm contract by claiming an office where no employees worked.

For someone who knows the workplace, the address and actual workforce are concrete facts. We work through certification and decertification questions with you against the award you know.

What Is the Meaning of Bid Rigging?

Bid rigging means arranging supposed competition to favor an agreed result. The buying agency sees competing offers while the bidders have already coordinated who should win.

What Are Types of Bid Rigging?

Cover bids deliberately lose to the intended winner. Bid suppression keeps a competitor out. Bid rotation lets participants take turns winning. Allocation divides customers or territories among participants. The bid, the communication behind it and the arrangement between the companies explain how the competition was manipulated.

What Are the Red Flags of Bid Rigging?

Shared bid preparation, deliberately losing offers, communications allocating work and false independence certifications are signs worth examining. An insider may know who supplied a rival’s price or why a company agreed to stay out.

A review published in the Creative Construction Conference proceedings in 2018, Review of Collusion and Bid Rigging Detection Methods in the Construction Industry, distinguishes statistical screening from the direct evidence insiders can provide. It puts trade knowledge at the center:

Notices originating from whistleblowers, thus insiders – former or current employees of the companies participating in collusions – are particularly valuable, for they usually include direct evidence of collusion.

Review of Collusion and Bid Rigging Detection Methods in the Construction Industry, Creative Construction Conference proceedings, 2018.

You may recognize the arrangement because you know how those companies ordinarily bid. We connect that knowledge to the offers and communications behind the award.

What Is the Procurement Collusion Strike Force?

The Procurement Collusion Strike Force coordinates the Justice Department’s Antitrust Division, U.S. Attorneys’ Offices, the FBI and agency inspectors general against collusion in government procurement and related funding. Its data-analytics work looks for signs of potential collusion for further investigation.

What Is a Procurement Integrity Violation?

Obtaining or disclosing protected bid or source-selection information before award can violate the Procurement Integrity Act. A bidder’s access to another bidder’s information can explain an advantage hidden from the purchasing office. The information, its recipients and the award chronology matter.

How Much Money Can a Whistleblower Get From a Qui Tam Lawsuit?

A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers. The potential government procurement whistleblower reward follows the recovery and the whistleblower’s share.

In the Oracle pricing case, the Justice Department announced that the former employee who brought the case would receive $40 million from the settlement. That role in contract services connected the whistleblower to the commercial-discount story behind the government’s purchases.

How Do You Assess My Potential Whistleblower Reward?

We assess the recovery your evidence could support and the share available in your case. The contract, affected charges and proof of what the company knew give that assessment substance. Speak to one of our Whistleblower Experts about what your evidence shows.

Can State or Local Procurement Fraud Qualify for a Reward?

Yes. Some state laws cover false claims involving state or local purchases and provide whistleblower rewards. We assess the purchase, its funding and the applicable law with you.
