LED Lighting Solutions: Supplier Letters, Direct Shipments and Origin Certifications

Whistleblower Justice Network

LED Lighting Solutions and its owner agreed to a $300,000 civil settlement over alleged false origin certifications involving a supplier letter, annual General Services Administration representations and direct shipments from China. The government alleged that the lighting supplier promised compliant products while supplying foreign-made goods, including products shipped straight from China to a government agency. For someone who knew the supplier, handled the orders or saw the shipping instructions, the contradiction was concrete: what the company told the buyer against where the goods came from.

The U.S. Attorney’s Office for the District of Connecticut announced the settlement on May 20, 2025. The agreement covered both civilian and military purchases. The Berlin, Connecticut company sold LED lights and lighting products through a General Services Administration schedule, and its civilian customers included the Coast Guard, GSA, the Department of State and the Department of Agriculture. This country-of-origin government procurement fraud case concerned the promises behind those sales.

The GSA Supplier Letter and Annual Certifications

According to the government’s account, LED Lighting Solutions provided a letter of supply attesting to its supplier’s Trade Agreements Act compliance before obtaining its General Services Administration Multiple Award Schedule contract in 2013. The company then certified compliance each year and identified no foreign end products on its product list.

The supplier letter addressed the source of the goods before the schedule contract began. In the government’s account, the annual certifications repeated the company’s compliance representation as agencies continued to order.

The Coast Guard and other civilian buyers ordered from the company’s schedule, as did the Air Force.

The government alleged Trade Agreements Act fraud under seven contracts or delivery orders. It contended that the company and its owner certified compliant end products even though some were manufactured in China, a country the release identified as outside the applicable trade-agreement protection. The alleged false promise reached the actual orders agencies placed.

For a person working with the product list, the useful connection is between the listed item, the supplier behind it and the order fulfilled under that listing. We examine those records together because a recurring assurance can conceal the same sourcing problem across separate purchases.

Direct Shipments From China Put the Promise to the Test

The government alleged that LED Lighting Solutions and its owner arranged for products under at least one contract to ship directly from China to the procuring agency. That puts the company’s sourcing decision and the agency’s delivery in the same transaction.

Compliant on paper. Straight from China to the agency’s door, according to the government.

Manufacturing records and shipment records answer different parts of that inquiry. The government alleged Chinese manufacture as well as direct shipment. The shipping record connects the product’s movement to the agency that received it. The supplier representation ties both back to what the contractor promised.

What Proof Do You Need as a Whistleblower?

Our whistleblower experts help connect what you know about the lighting supplier or shipment to the origin promise behind the government’s purchase.

What Are the Indicators of Government Procurement Fraud?

In an origin case, a useful indicator is a contradiction between the government’s purchase requirements, the contractor’s certification and the records showing what it supplied. LED Lighting Solutions illustrates that comparison through the alleged Chinese manufacture and direct delivery behind its compliance assurances.

The order and billing records connect that contradiction to the government’s purchase. We follow the product through those records so that the inquiry concerns identifiable goods and charges. The employee who knows the shipment and the employee who knows the invoice may be describing different parts of the same sale.

Buy American Orders Carried a Different Promise

The government’s separate Buy American Act fraud allegations concerned eight contracts or delivery orders with the Air Force, Army and Federal Emergency Management Agency. The company and its owner allegedly certified domestic end products while supplying some foreign end products.

The Buy American Act creates a preference for domestic end products. The Trade Agreements Act governs covered purchases using a different origin framework. The LED Lighting Solutions announcement describes the schedule allegations and the Buy American orders separately because the promises were different.

Under the federal purchasing rules on origin, Buy American treatment can involve U.S. manufacture and domestic component costs, with exceptions. Trade-agreement treatment can turn on where an article was manufactured or transformed into a new article.

We work from the applicable contract and its certificates to the records of production and delivery, including any exceptions identified in the offer.

What Is a False Certification?

The government alleged that LED Lighting Solutions made false certifications that its lighting products met the orders’ origin requirements.

The supplier letter and annual certifications identify assurances made before a particular shipment. We connect those assurances to the sourcing information available inside the company at the time and to the later order and charge.

The people who handle those records may see the discrepancy before anyone outside the company does. Your knowledge may be the explanation that connects a supplier’s manufacturing information with a certification prepared elsewhere in the business. Our work with you is to establish that connection precisely, including who knew the sourcing facts when the representation was made.

The Civil Settlement Covered the Company and Its Owner

The civil agreement resolved allegations against both LED Lighting Solutions and its owner under the False Claims Act. The government attributed the challenged certifications and the direct-shipment arrangement to both.

The investigation was conducted by the Defense Criminal Investigative Service, the Defense Contract Audit Agency Operations Investigative Support Division, the General Services Administration Office of Inspector General, the Department of the Army Criminal Investigative Division, the U.S. Coast Guard, the Air Force Office of Special Investigations, the Federal Bureau of Investigation, and the Department of Justice Office of Inspector General.

The Same Origin Problem in Other Products

In the Instec settlement announced in September 2022, the government alleged that scientific instruments certified as domestic were manufactured in China. The Department of Energy and NASA were among the purchasers. A former employee brought that whistleblower case. The product was different, but the comparison was familiar: the domestic certification against the manufacturing source.

The ICP Medical settlement announced in January 2017 involved government allegations that Chinese body bags, gowns and scrubs were repacked after origin labels were removed, with U.S. flag stickers placed on some packages. The Department of Veterans Affairs bought the products. That allegation brings packaging into the same inquiry: what the buyer was told about origin and what people handling the goods knew.

These cases show why we follow the product through the business. The relevant information can sit in a certification, a supplier record, a shipment or packaging handled before delivery. The strongest account connects those records to the same government purchase.

A whistleblower case under the False Claims Act can pay a whistleblower reward of 15% to 30% of what the government recovers.
