Caltrans Contract Manager Bid Rigging: The Buyer Helped Manufacture the Competition

Whistleblower Justice Network

Caltrans contract steering and sham competitive bids let contractors manufacture competition with help from the public buyer. In its announcement of the criminal case, the Department of Justice described admissions that a Caltrans manager and two contractors arranged competitions. Knowing who prepared the bids meant knowing more than the forms showed.

The former contract manager at the California Department of Transportation pleaded guilty to bid rigging and bribery on April 11, 2022, as the department’s Procurement Collusion Strike Force overview records. His position puts the buyer’s own conduct at the center of the case. The contractors’ arrangement reached inside the public agency responsible for the purchase.

How the Caltrans Competition Was Arranged

The criminal admissions described in the Department of Justice announcement show sham higher bids protecting the intended winner from actual price competition. A supposed competing company supplied the losing offers.

The winning offer and the losing offers tell a story together. A losing bid can make the favored company’s price appear to have survived a contest, even when the participants have already agreed how that contest will end. The buyer receives documents that look like competing offers. The arrangement supplies the outcome.

The Department of Justice describes bid rigging as firms agreeing to bid so that a designated firm wins. Caltrans adds the official’s participation to that mechanism. An insider may know both sides of it: what the contractor submitted and what the buyer understood about the supposed competition.

We see the absurdity in calling that a competitive purchase. The referee was on a team.

What the Supposed Competitor Hid

The Department of Justice’s announcement describes a company with a contractor’s wife as nominal president submitting sham bids as part of the criminal admissions. That nominal leadership puts a practical question at the center of the case: who controlled the bid bearing the company’s name?

We examine who selected the price, who prepared the offer and who communicated with the other bidders. The ownership records and management arrangements belong beside those communications. Together they can show how a decision reached the bid form, and whose decision it actually was.

For an estimator, the meaningful difference is between pricing a job the company intends to win and supplying a number that lets someone else win. For a purchasing employee, it is the connection between the submitted offers and the people arranging them. A company title tells the public who appears to run the business. The bidding records can show who ran the supposed competition.

What Proof Do You Need as a Whistleblower?

For a sham-bid case, the useful proof connects the purportedly independent bids to the communications and decisions that produced them. We work with the bidder’s records, the buyer’s records and the payment trail to understand the purchase as a whole.

An estimate can show the costs behind an offer, while communications may explain why the submitted price changed. The contract and payment records connect those decisions to what the government bought and paid for. We assess that connection with you.

You may know who supplied a supposedly independent number or who directed a company to submit a bid it intended to lose. A bid file can contain the result of a decision without explaining who made it. Your knowledge gives those documents context.

What Are the Red Flags of Bid Rigging?

Communications about competing prices, intentionally losing bids and hidden control of supposed competitors are red flags of bid rigging.

The construction literature adds a useful comparison between the prices offered and the costs of doing the work. A 2018 Creative Construction Conference paper, Review of Collusion and Bid Rigging Detection Methods in the Construction Industry, describes a study of a Long Island road-construction cartel. The cartel’s bids were less dispersed and less closely connected to measures of service costs than the bids of firms outside the cartel.

For an estimator, that points to the working numbers behind the bid: what the job was expected to cost and how the submitted price was chosen. The paper treats statistical screening as a way to identify markets for closer examination. It gives particular weight to people inside the companies:

Notices originating from whistleblowers, thus insiders – former or current employees of the companies participating in collusions – are particularly valuable, for they usually include direct evidence of collusion.

That is the contribution an award spreadsheet cannot supply by itself: someone who knows how the numbers were chosen and can connect them to the communications behind the bid.

Why a Losing Bid Can Still Pay

The Fourth Circuit’s opinion in the criminal case against a Contech Engineering Solutions executive describes how Contech could earn money even when Pomona Pipe Products won, because Pomona used Contech’s aluminum.

Honest contractors price their work against what they expect to be competing offers. A staged contest protects the intended winner from that pressure. As the Department of Justice explains, collusive bidders hold themselves out as competitors while agreeing not to compete, making taxpayers pay more and depriving the buyer of the benefits of competition.

A State Buyer and a Federal Criminal Case

Caltrans was the state buyer in a federal criminal prosecution. The Department of Justice’s strike-force overview describes work involving federal, state and local purchasing and funding.

The strike force brings together the Department of Justice’s Antitrust Division, U.S. Attorneys’ Offices, the Federal Bureau of Investigation and federal inspectors general. For a whistleblower inquiry, we examine the particular contract, the government money involved and the representations used to obtain it.

The Government Payment Behind a Whistleblower Case

For a government procurement whistleblower, the connection to payment is central: what the buyer was told, who arranged the bids and which claims followed the award. We assess how the bidding arrangement connects to a potential qui tam case and bring in government procurement fraud whistleblower lawyers who understand government payment claims.

A whistleblower case under the federal False Claims Act can pay 15% to 30% of what the government recovers. If you know how a supposedly competing bid was produced, that is a concrete place to begin a conversation with our experts.

You Know Who Chose the Bid

If you saw a losing price supplied, a supposed competitor directed or a public buyer helping arrange the contest, talk with our whistleblower experts about the bids you know. We work beside you to turn that inside knowledge into your strongest government procurement whistleblower case, connecting the bidding decisions to the government payment and bringing in whistleblower lawyers who know procurement collusion.
