CFTC Whistleblower Retaliation: When the Firm Makes Reporting the Problem

Whistleblower Justice Network

CFTC whistleblower retaliation concerns belong alongside the trading conduct you reported. Our whistleblower experts assess both with you. You may know the trades, the customer accounts or the instructions behind the conduct. You may also have questions about what happened at work after you spoke up. We shape the case with you, bringing in CFTC whistleblower lawyers who understand the market conduct and the employment concerns together.

How Does the CFTC Protect Whistleblowers?

The Commodity Futures Trading Commission has whistleblower protections under the Commodity Exchange Act. We work through how they apply to your reporting and employment circumstances with you. Protection, confidentiality and award eligibility belong in that conversation from the beginning.

What Qualifies as Whistleblower Retaliation?

We assess that with you from the reporting, the employer’s response and the working relationship. An internal concern, cooperation with investigators and a change in employment each belong in the conversation.

The DV Trading case shows why. The dispute involved partnership discussions, trading arrangements and an alleged effort to make traders absorb the firm’s regulatory bill.

DV Trading and the Penalty It Allegedly Tried to Pass On

In 2016, the Commodity Futures Trading Commission imposed a $5 million civil penalty on DV Trading to settle allegations of wash trading in Eurodollar futures. Three traders later alleged that the firm pressured them over cooperation with the CFTC investigation and tried to make them pay part of its penalty. The court’s account of their allegations connects the regulatory investigation to conversations about their future at the firm.

They traded through their own trading companies, using DV’s house account. The arrangements divided trading profits and losses between the traders and DV. Their companies paid them, and DV required them to trade exclusively for it.

According to the traders’ allegations recounted in the opinion, discussions with DV partners led them to expect partnership in a new business spun off from DV. They alleged that the partners pressed them to pay a portion of the penalty as part of that arrangement. The traders said they left instead of accepting the pressure.

Help investigators examine the firm’s trading, then shoulder the firm’s bill. We see an absurd bargain in the traders’ account: a path to partnership that came with a share of the penalty.

CFTC Retaliation Claim After Termination

A CFTC retaliation claim after termination raises questions about the report and the employment chronology that we work through with you. That includes whether a concern was raised before departure, whether a report followed termination, and what communications accompanied each event.

We want to understand your role, the market conduct you recognized and the employer’s response in context. If arbitration or a separation agreement is part of that history, we bring those questions into the assessment with CFTC whistleblower counsel. You do not need to settle them yourself before speaking with us.

How Much Can You Sue for Whistleblower Retaliation?

We assess the potential claim with you and CFTC whistleblower lawyers from your employment arrangements, the losses involved and the facts behind the report. CFTC whistleblower special damages, back pay and reinstatement are matters for that individual assessment. Your compensation records and agreements give that conversation something concrete to work from.

Rewards for information are a separate part of the picture. CFTC whistleblower awards range from 10 to 30 percent of collected monetary sanctions, shared among qualifying whistleblowers in an action. A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers. Those are different programs. We assess the reporting opportunity and the employment concerns together, with the right whistleblower lawyers for the conduct you know.

Trafigura’s Settlement Over Reporting Restrictions

Trafigura Trading’s CFTC settlement shows how an employment agreement itself can become part of an enforcement action. In its June 2024 announcement, the Commission described its first action over impeding whistleblower communications.

The Commission alleged that employment and separation agreements lacked express exceptions permitting voluntary reporting to the agency, creating confusion that impeded communications. The settlement imposed a $55 million civil penalty to resolve the trading and reporting-restriction allegations together.

The trading allegations included misuse of Mexican gasoline pricing formulas and import information supplied by an employee breaching duties, as well as attempted benchmark manipulation. That puts the employment paperwork in context: the Commission was examining both conduct in the market and restrictions on the people who could tell it about that conduct.

Here, the alleged obstacle sat in the employment paperwork. In the DV Trading dispute, the traders alleged pressure connected to cooperation with investigators.

We look at the agreements and the circumstances with you. If a confidentiality clause has become part of your concern about speaking up, it belongs in that discussion with our experts and CFTC whistleblower counsel.

The Market Records Behind the Workplace Dispute

On a trading desk, filled orders tell only part of the story. Unfilled and canceled orders, timestamps and communications can show how a trading strategy operated. Swaps records include daily trading information and communications before execution. We connect your knowledge of those systems to the conduct you reported.

For someone working with customer assets, the useful records may concern financing terms, asset movements and withdrawal control. For someone who knows how confidential information moved, access rights and the trading sequence can carry the point. Your knowledge gives the records their business meaning: which account mattered, what an instruction meant and how the transaction worked.

A 2019 International Labour Organization working paper reviewed whistleblower protection in the public and financial services sectors. It cited a study in which most whistleblowers first tried internal procedures and turned to external channels when those attempts failed. The paper also argued for oversight mechanisms independent of pressure from the hierarchy.

An employee may already have spent considerable effort trying to get the business to address a problem. We want to understand those conversations alongside the market records, the agreements and the decisions that followed.

Your Knowledge Deserves an Advocate

If you know the trading conduct and are concerned about the firm’s response to your report, speak with our whistleblower experts about both. We build the case around your market knowledge, bring in CFTC whistleblower lawyers who understand the employment issues, and stay beside you through the process.
