Antitrust Whistleblower Evidence: Connecting the Agreement to Bids, Prices and Payroll

Whistleblower Justice Network

Antitrust whistleblower evidence connects an agreement between competitors to the bids, prices, customers or wages it changed. You may know why a bid was raised, why a recruiter stopped approaching a rival’s employees, or who instructed a pricing team to follow a competitor. The message explains the decision. The business records show what happened next. Together, they can expose the competition that customers or workers were supposed to have.

Customers lose price competition, and workers lose competition for their wages and skills. We build the connections with you, including the instructions that changed and the exceptions that matter. Your knowledge of how the business actually operates gives those records their meaning.

What Is the Role of Whistleblowers in Bid Rigging Cases?

Whistleblowers can explain who agreed with whom and connect that agreement to actual bids. A conversation, meeting note or message may identify the intended winner. The revised offer, approval and later work can show how the arrangement reached the customer.

The useful detail is often specific to the trade: the product covered, the customer reserved for a rival, the territory someone agreed to leave alone, or the part of a price competitors discussed. A sales manager may understand an allocation instruction that looks unremarkable to somebody outside the business. An estimator may know why a quote changed after contact with a competing bidder.

Bid Worksheets and the Decision to Lose

Bid worksheets become useful evidence when they connect the company’s intended offer to the offer it actually submitted. An earlier version, the instruction to change it and the approval of the final price can explain how a supposed competitor became the designated loser.

In the military-shelter case involving Berg Companies, the purchasing arrangement required independent competitive quotes. Berg admitted coordinating and submitting inflated quotes, according to the Department of Justice’s settlement announcement. The government alleged that the quotes helped designated sub-vendors win. Berg agreed to a $3.3 million civil False Claims Act settlement over shelter purchases that were supposed to put vendors in competition for government business.

The buyer had several quotes. The allegation was that the competition between them had already been arranged. For an insider, the connection worth explaining is the rival’s price, the instruction inside your company and the version ultimately sent to the buyer. Losing-bidder subcontracts and payments can extend that account beyond the award itself.

Auction Access Can Explain Who Controlled the Bids

The EBLOCK agreement connects maximum bids, special account permissions, fake dealer identities and shared inventory to the auctions they changed.

Platform, development and finance staff may recognize different parts of the same arrangement: access permissions, automated bids and shared profits. Permission histories, bid tables and audit logs could connect those accounts to particular auctions.

The EBLOCK $1 million award shows the outcome of that reported auction evidence; the records determine what a different report could support.

Pricing Approvals, Algorithms and Competitor Data

Pricing evidence can connect a competitor discussion to the instruction that changes a price. For a technical employee, the useful history may include the agreed product, the pricing settings and the instruction those settings were meant to implement.

A poster seller’s executive admitted in a criminal plea agreement that competing sellers discussed and agreed on prices for selected posters sold through Amazon Marketplace. They then agreed to adopt pricing algorithms to coordinate changes to those prices. The agreement came first. The software supplied the means to carry it out.

For a developer or pricing analyst, configuration history paired with competitor instructions could connect the commercial decision to implementation. Pricing approvals can show who authorized the change.

When the Anonymous Report Names the Rival

Competitor-data evidence can show how a business identified a rival behind an apparently anonymous report and used that information in pricing decisions. In its civil complaint against Agri Stats, the government alleged that chicken, pork and turkey processors exchanged detailed information about current costs, output and prices through the service.

The complaint alleged that processors could identify particular facilities within the reports and track their data across reports. It described the work inside one processor:

Tyson held regular internal meetings in which its employees analyzed deanonymized Agri Stats pricing information about certain cuts of pork from its competitors’ facilities. Dubbed the “naming process,” Tyson’s process for deanonymizing pork facilities involved multiple employees from different departments.

Government allegation, United States of America, State of Minnesota, State of California, State of North Carolina, State of Tennessee, State of Texas, and State of Utah v. Agri Stats, Inc., second amended complaint, paragraph 92.

The government also alleged that meat purchasers and workers were refused access to the reports. Competitors could see information their customers could not. That asymmetry is part of the alleged mechanism.

The work used to identify facilities, access records and pricing instructions could show how a data team turned the report into a decision about price or production.

Payroll and Hiring Records Show What the Agreement Changed

Payroll and recruiting records can connect an agreement between employers to wages and job opportunities. The communication between competitors, the instruction to recruiters and what happened to affected workers are different parts of the same inquiry.

The VDA OC plea connects a conversation and email with restrictions on hiring district nurses and raising their pay.

Recruiter correspondence, assignments and payroll could connect that agreement to particular nurses. We examine the hiring instructions with you alongside what recruiters actually did, including hires and exceptions. A worker’s wage history can give the agreement a concrete meaning beyond the email that recorded it.

Antitrust Report Timeline Evidence and Contrary Documents

We put the timeline and contrary documents together to understand how the agreement worked. We examine the competitor contact, the instruction that followed, the business’s response and the records that show changes or exceptions. A rejected proposal, a different instruction or an actual transfer can matter to the meaning of the surrounding messages.

The EBLOCK chronology connects a rejected software feature and ended profit sharing with later concealed activity, so contrary records belong in the evidence account.

Under its criminal deferred prosecution agreement, EBLOCK admitted that it refused to bring the fake-bidding function onto its own platform and ended the profit-sharing arrangement. Legacy employees nevertheless concealed continuing activity, including sharing vehicle information outside the platform’s controls.

For a compliance or technical employee, the sequence could connect a management instruction to an access change, then to activity that moved outside that control.

How Is Bid Rigging Detected?

Use the bid-rigging red flags to identify questions for witnesses, then connect the offers to the instructions behind them.

A review published in the Proceedings of the Creative Construction Conference in 2018 explains why statistical screening and insider information complement each other. Screening can identify suspicious market behavior. The review explains why information from people inside the business carries particular weight:

Notices originating from whistleblowers, thus insiders – former or current employees of the companies participating in collusions – are particularly valuable, for they usually include direct evidence of collusion.

The practical connection is the person who can explain the pattern. A procurement spreadsheet may identify the recurring winner. An estimator’s account may explain the instruction behind a deliberately losing bid. We examine the pattern alongside the communications, business context and contrary documents that give it meaning.

Competitor Prices and Company Records

Our whistleblower experts can help you address how to report competitor prices without taking privileged files. Questions about authorized access and your own role belong in that conversation with us and antitrust whistleblower counsel.

Government-directed cooperation and private recordings raise questions we address with you and your antitrust whistleblower lawyers.

The Department of Justice’s November 2024 compliance guidance asks how companies preserve electronic communications, including disappearing messages and communication outside company systems. That makes the communication channel part of the evidence discussion, alongside the message’s contents and the decision it concerned.

The Evidence Behind a Whistleblower Case

The Department of Justice and Postal Service’s antitrust whistleblower reward program can pay for information about qualifying criminal antitrust and related offenses. We assess the conduct, the affected transactions and your knowledge of them, and work through the program’s requirements with you.

Government purchasing adds another question: how did the coordinated bidding connect to false claims or statements affecting government payment? Berg’s shelter purchases show that connection in a civil settlement. A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers.
