Mortgage Underwriting Defects and the False Claims Act: What the File Said Before the Government Paid

Whistleblower Justice Network

Mortgage underwriting defects can support a False Claims Act case when a lender knowingly certifies false information that matters to a claim for government money. You may have seen the income discrepancy, the condition someone waived, or the quality-control finding that never reached the Department of Housing and Urban Development. The important connection is between what the business knew, what it certified and the payment it sought. This page follows that connection from the loan file through insurance, servicing and repayment records.

Does an Underwriting Defect Prove Fraud?

Proving mortgage fraud under the False Claims Act requires evidence of a knowing false claim or a false statement that matters to one. That includes a lender that knew the information was false, deliberately avoided learning the truth or recklessly ignored it. Inside a lender, that puts the original file beside the warnings, exception approvals and decisions made before the certification went out.

The statement must also matter to the payment decision. An underwriting condition, a quality-control label and an agency’s response each tell part of the story. We examine what the lender understood at the time and how the false information affected the request for money. For claimed government losses, the evidence also has to connect the false statement to those losses.

Who Made the Mortgage Certification?

The borrower, originator, underwriter and certifying mortgagee can make different statements about the same loan. The Federal Housing Administration’s loan application addendum separates borrower statements, credit underwriting, property underwriting and endorsement certifications. An annual corporate certification concerns the lender’s continued approval and has a different scope from a signature on an individual loan. The April 2023 loan application addendum ties material correctness to the Defect Taxonomy in force at endorsement.

Under FHA Direct Endorsement, the mortgagee determines eligibility and submits the loan for insurance without the Department of Housing and Urban Development generally reviewing the application beforehand. Automated underwriting uses the data entered into it, while property underwriting remains a separate responsibility. The employee who supplied the income figure, the underwriter who adopted it and the person who certified the loan may each explain a different part of the decision.

The payment promise changes with the program. The Federal Housing Administration insures mortgages, the Department of Veterans Affairs provides a guaranty for qualifying lender loans, and the Department of Agriculture both makes direct housing loans and backs private lenders’ loans. We connect the certification to the program and rule the lender was actually using.

What Does a Defective Loan File Show?

A defective file can expose the difference between the source documents and the information used to approve the loan. Income, employment, assets, gifts, debts, occupancy and appraisal support all bear on underwriting. The next question is who saw the discrepancy and who had authority to clear or waive the condition.

The Financial Crimes Enforcement Network’s November 2006 mortgage assessment distinguished buyers seeking property for personal use from profit schemes involving industry insiders. Its review of suspicious-activity reports described altered bank statements, false earnings documents, fabricated gift letters and undisclosed debts. Those records put the source of the information in view. The lender’s review and certification show how it reached a government-backed loan.

Freedom Mortgage Found Defects and Reported Almost Nothing

Freedom Mortgage admitted that it certified ineligible FHA loans and agreed to a $113 million settlement in 2016. During 2006 through 2008, early-payment-default findings did not reach production and underwriting management. During 2008 through 2010, completed early-default reviews showed defect rates above 30% in that reviewed population.

Freedom also admitted that it reported no improperly originated loan to the Department of Housing and Urban Development during 2006 through 2011. In 2012, after identifying hundreds of loans that potentially required reporting, it reported one. We see a review process considerably busier than the reporting process.

If you worked in quality control, we trace the finding as first written, who received it and what was reported. The original underwriting file and the later review file show what changed and when, including the defect classification and management’s response. If management changed who signed after a finding, we trace who actually reviewed and certified the loan.

Guild’s Alleged Condition Waivers Reached an Insurance Claim

The Justice Department’s complaint against Guild Mortgage alleged that its system distinguished cleared conditions from waived conditions, but underwriters waived mandatory FHA requirements. It also alleged that uncertified junior underwriters cleared conditions on manually underwritten loans. According to the complaint, the difference between satisfying a requirement and overriding it was visible inside the loan system.

One alleged example joined insufficient rental-history verification, omitted business expenses and missing alternative credit support to a particular loan. The complaint alleged that the borrower made only two payments before the Department of Housing and Urban Development paid $317,233 on the insurance claim. Another example alleged that a junior underwriter cleared gift-fund conditions despite a direct endorsement underwriter’s personal-review certification. Guild later agreed to a $24.9 million settlement resolving allegations concerning ineligible loans, quality control and self-reporting.

These allegations connect the condition, the person authorized to review it, the certification and the claim. If you saw a known defect discovered before endorsement, the original finding and the decision to proceed can explain what the certification concealed.

Can a Defaulted-Loan Sample Prove Loss?

A defaulted-loan sample can help prove loss when the evidence explains how the alleged defects caused the losses. Aggregate evidence succeeded in the Allquest and Americus case. We work with the insider who knows the files to connect the original income documents, the reason for default and the loans used for comparison.

In the Carrington Mortgage Services case, a former direct endorsement underwriter examined 349 defaulted FHA loans. The Seventh Circuit found enough evidence for a jury to consider whether the certifications mattered to payment, but left judgment for Carrington because the evidence did not adequately connect the defects to the losses. A servicing code showing reduced income could describe a later job loss or an original income misrepresentation. The file behind the code can explain the difference.

The money trail continues after an insurance payment. The Federal Housing Administration can acquire a mortgage or property when it pays a claim, and later collections can return value to the government. We follow those proceeds and reimbursements alongside the claim payment for the loans at issue.

Why Does VA Keep Paying a Holder?

The Department of Veterans Affairs can be required to pay a later holder of a loan even when the originating lender’s certification is disputed. In the Mortgage Investors Corporation case, whistleblowers alleged that prohibited attorney closing fees were bundled into permitted title charges before the lender certified that no impermissible fees had been imposed. The alleged false statement concerned the origination, while the later payment could go to a different holder.

The Eleventh Circuit found that audits and refund demands left a real dispute about whether the fee certifications mattered, even though the department continued paying protected holders. We trace the invoices and closing statement through the lender’s certification and the agency’s response with the insider who knows how the fees were recorded.

How Do Mortgage Servicing Overclaims and Retained Payments Differ?

An origination case follows false eligibility information into mortgage insurance or a guaranty. A servicing overclaim follows a later date, expense or calculation into a payment request. A retained-payment case follows money received into an established obligation to return it.

In the Financial Freedom case, the Justice Department alleged claims for excess interest on reverse mortgages without proper disclosure of missed appraisal, foreclosure and claim-submission deadlines. For HECM interest after an approved extension, the extension and the servicing milestones belong beside the interest calculation and the claim version that reached the Department of Housing and Urban Development.

The Walter Investment settlement announcement described a different alleged expense mechanism. The Justice Department said a 6% sales commission included 5% for the selling agents and a 1% referral component routed through intermediary companies, with most of that component returning to the reverse-mortgage servicer. Walter agreed to pay $29,630,000 to resolve allegations that included those charges and excess interest. In the Justice Department’s account, the claimed expense and where the money went told different stories.

If a Mortgage Recovery Advance payoff was received but never remitted, the question is who owed the money back, and when. The Department of Agriculture’s housing-loan rules address advance reimbursements and remittances following repayment, release or title transfer. A False Claims Act inquiry into knowing retention connects that established duty to the receipt, the responsible entity and the decision to keep the money.

Is an Enterprise Repurchase an FCA Claim?

A False Claims Act case involving an enterprise repurchase follows a knowing false statement into a qualifying request for government money. Fannie Mae and Freddie Mac buy mortgages, and Fannie Mae’s selling warranties can require a lender to take responsibility for a defective loan regardless of what it knew. We examine what the seller knew when it made the representation and whose money supported the purchase.

The Ninth Circuit ruled that Fannie Mae and Freddie Mac were not acting as federal officers, employees or agents in the mortgage sales before it. It left open a different basis for a False Claims Act case involving federal money used for a government purpose. That makes the particular purchase and its funding part of the evidence we assess with you.

Who Holds Retained Invoices?

The lender or servicer may retain the supporting invoices even when they no longer routinely accompany an agency submission. The Department of Veterans Affairs’ June 2026 invoice change removed routine submission of covered invoices while retaining the lender’s duty to keep them and produce them on request. The agency packet and the operational file can therefore hold different parts of the same transaction.

An underwriter may know why a condition disappeared, while a quality-control analyst may know who received the finding. In an FHA claim, the lender holding the mortgage, the servicer and the submitter can be different parties. A servicing employee may know which claim version carried the charge. We connect those decisions to the money requested and paid.

What Reward Can a Mortgage Fraud Whistleblower Receive?

A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers. We assess that qui tam opportunity with you against the mortgage transaction and the evidence behind it.

Mortgage cases can also involve other federal penalty and reward laws. We identify the route that fits what you know and stay beside you as the case develops.
