How to Report Mortgage Fraud: Match the Evidence to the Right Route

Whistleblower Justice Network

If you want to know how to report mortgage fraud, start with our whistleblower experts and the connection between what you saw and the money the company claimed. You may know which underwriting condition someone waived, which quality-control finding management received, or which servicing deadline disappeared from a claim. We work with you to connect that knowledge to the mortgage program and a potential whistleblower case.

Which Mortgage Program Is Behind the Claim?

The mortgage program determines whose money supported the loan and what the lender or servicer promised in return. The originator, underwriter, current holder and company submitting a claim can be different businesses. Knowing who prepared a document and who adopted its contents helps us follow the responsibility through those handoffs.

For FHA loans, the chain runs from the lender’s eligibility certification to insurance endorsement and a later insurance claim. Home Equity Conversion Mortgages add reverse-mortgage servicing questions: when the loan became due, which deadlines applied, and what principal, interest or expenses the mortgagee claimed. A servicing employee may know the disputed interest calculation even without having worked on the original loan.

VA loans connect the lender’s loan and fee certifications to a federal guaranty and possible payment to a later holder. USDA housing has separate direct lending and loan-guaranty programs: USDA lends directly in one, while a private lender supplies the principal in the other. That difference puts eligibility, payment assistance, loss claims and repayment obligations in different places. We trace the particular payment with you.

Fannie Mae and Freddie Mac purchase mortgages and reimburse certain servicing expenses. Ginnie Mae provides a federal guaranty of payments on qualifying mortgage-backed securities, a separate promise from the underlying FHA, VA or USDA protection. For an enterprise purchase or reimbursement, we examine the particular request, its funding and the company’s representations.

What Does Your Mortgage Fraud Evidence Show?

Mortgage fraud evidence connects the original loan or expense record to what the company certified and what the payer received. Income, employment, occupancy, assets, debts and the appraisal can each supply part of that comparison. The lender’s approval records show who accepted the information, while quality-control findings and management communications can show what the business knew.

HUD’s loan certification form separates borrower statements, credit underwriting, property underwriting and endorsement certifications. Those are different decisions about the same loan. For an underwriter who saw a condition waived or a reviewer who raised an unresolved defect, the dates and versions show what was known when the certification was made.

Quality-Control Findings Can Stay Inside the Lender

Freedom Mortgage admitted that it certified ineligible FHA loans and failed to share early-default review findings with production and underwriting management during part of the period at issue. It reported no improperly originated loan to HUD during 2006 through 2011. After identifying hundreds potentially requiring reporting, it reported only one in 2012.

If you worked in quality control, your knowledge of who received the findings and what happened next can connect the review to the decision inside the business. We see a reporting system that barely reported.

A Repurchase Demand Can Reopen the Loan File

Problems can surface well after closing, when a purchaser demands a repurchase or an insurer examines a claim. In its February 2009 mortgage fraud analysis, the Financial Crimes Enforcement Network identified repurchase demands, foreclosures, insurer reviews and early defaults as events associated with detecting suspected fraud.

That history speaks to the employee reviewing a loan after someone else approved it. The original file, the review that challenged it and the response to that review can show both the representation and the later decision to stand behind it.

Who Holds Retained Invoices?

The lender may hold invoices even when they do not routinely accompany a VA loan-file submission. VA’s June 2026 invoice change concerns support for covered veteran-paid loan fees and charges. It removed routine invoice submission for the covered files while preserving the lender’s duty to retain the invoices and produce them on request.

FHA servicing claims have their own supporting records, which lenders must retain. For a servicing insider, the useful comparison can be the invoice against the claimed expense, or the servicing history against the dates entered on the claim. Original submissions, corrections, approved extensions and actual payment records show different parts of that account. We work through those connections with you.

When Does a Mortgage False Claims Act Case Fit?

A mortgage False Claims Act case can involve a lender or servicer knowingly using false information to claim government money. We examine what the company knew, how the information affected payment and how it caused the government’s loss. A qui tam case allows a whistleblower to bring a claim in the government’s name. We assess that route with you, including when the issue first appeared as a mortgage servicing complaint.

A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers. We examine the loan and payment history with you and bring in mortgage fraud whistleblower lawyers for the case’s legal requirements.

The Justice Department’s account of its complaint against Guild Mortgage shows the connection in concrete terms. It alleged that underwriters waived mandatory FHA conditions and that junior underwriters cleared conditions on loans requiring qualified review. Its loan examples connected those decisions to certifications and specific HUD insurance payments. Guild later agreed to settle the FHA allegations.

For the employee who saw a condition disappear from the approval screen, that is the useful link: the decision inside the loan file followed by the certification and the insurance claim. The complaint’s examples show why we examine the company’s handling of the defect alongside the payment it generated.

What Is the Difference Between FIRREA and a FIAFEA Declaration?

FIRREA gives the Justice Department a civil-penalty route for specified financial fraud. The Financial Institutions Anti-Fraud Enforcement Act provides a separate declaration and award route tied to qualifying conduct. We assess which route fits the transaction, the institution involved and the information you know.

A civil declaration award can follow a government recovery tied to a qualifying declaration. Questions about reporting anonymously or using a confidential declaration belong in our conversation with you and mortgage fraud whistleblower counsel.

Financial Freedom Shows Why the Route Matters

The Justice Department’s Financial Freedom investigation began with a declaration from a consultant who worked with estates of reverse-mortgage borrowers. The department alleged that the company sought FHA interest without properly disclosing missed appraisal, claim-submission and foreclosure deadlines. The disputed money was additional interest tied to those servicing failures.

The company entered a $68,274,944 settlement, while earlier refunds exceeded $21 million. The Justice Department separately announced a $1.6 million declaration award. The consultant’s knowledge connected the servicing history to the interest claims, and the announced award used the declaration route. For someone outside the lender who understands those records, the case gives that knowledge a concrete place in the investigation.

When Does Mortgage Evidence Point to Another Whistleblower Program?

False statements to investors about mortgage-backed securities can raise a securities question, while mortgage-linked derivatives and tax conduct have their own enforcement routes. The Securities and Exchange Commission, Commodity Futures Trading Commission and Internal Revenue Service each have separate whistleblower programs with their own qualifying violations. We examine what the information shows before choosing the relevant expertise.

Money-laundering and suspicious-activity-reporting issues also require their own analysis. If your knowledge crosses from loan certifications into investor disclosures or the movement of funds, we connect those parts of the matter with whistleblower lawyers who work in the relevant field. The same mortgage file can contain evidence useful to different inquiries.

Does a Hotline Report Earn an Award?

A hotline report does not automatically earn an award. A False Claims Act recovery share and a FIAFEA declaration award depend on their own routes and requirements. We work with you to identify a potential reward-bearing case from the transaction and evidence you know.
