DME Fraud Settlements and Cases: The Order, the Bill and the Business Behind It

Whistleblower Justice Network

DME fraud settlements cover paid referrals, altered medical records, unnecessary supplies and equipment bills that kept coming after payment should have stopped. Medicare and patients paid for decisions made inside these businesses. Arriva Medical, Lincare, ResMed and the other companies below reached different resolutions over different parts of that business. If you work with orders, deliveries, claims or supplier accounts, the useful comparison is the decision inside the company that made the bill possible.

Manufacturers Sit Beside Suppliers in the Settlements

Philips Respironics’ September 2022 settlement included approximately $4.3 million as the whistleblower’s share of the federal recovery. The settlement also required separate payments to the states for their Medicaid programs.

The Health and Human Services Office of Inspector General’s Medicaid Fraud Control Units Fiscal Year 2023 Annual Report, published in 2024, found that medical device manufacturers and durable medical equipment suppliers accounted for more civil settlements and judgments than other provider types in fiscal year 2023. Its findings put manufacturers beside suppliers in the enforcement picture. The conduct can begin before a supplier submits a claim.

The Decisions Behind the Claims

Oxygen Billing That Continued Without the Supply

Rotech admitted knowingly billing Medicare for portable oxygen contents patients did not use or need, regardless of whether it delivered them. The charge had become detached from the supply.

Lincare’s oxygen-rental settlement went further inside the business. It admitted billing Medicare, Medicare Advantage plans and beneficiaries after receiving three years of rental payments. It also admitted that employees raised concerns and that regional billing officials and headquarters instructed them to continue. The people questioning the bills were being overruled by the people responsible for them.

The oxygen rental cap ends the equipment payment while service obligations and the supply business continue. Lincare admitted its controls for Medicare Advantage plans and patients were inadequate, and its controls for traditional Medicare did not always work. The recurring bill survived the payment it was supposed to collect.

Wheelchair Records Allegedly Written by the Seller

The government alleged that Orbit Medical sales representatives changed prescription dates, altered medical records, forged physician signatures and added fax stamps to make documents appear to have come from doctors’ offices. Former employees brought the qui tam case. Orbit and Rehab Medical, which took over part of its business, settled.

Numotion’s later settlement concerned allegedly false patient evaluations authored, completed or signed by its employees instead of qualified medical professionals. These cases put a specific question inside a seemingly complete file: who supplied the clinical judgment, and who supplied the paperwork?

A product’s physical history can contradict the claim too. The Hillrom whistleblower complaint alleged that used Clinitron beds were represented as new. The complaint described a service-record check that traced a bed’s serial number to a prior patient. For someone servicing or handling returned equipment, that history can explain a distinction that a billing code alone conceals.

Manufacturers Accused of Paying for the Next Order

ResMed’s settlement covered allegations of free patient outreach services, free or below-cost sleep equipment, and arrangements backing interest-free loans for suppliers. Those benefits reached the businesses and clinicians that could direct equipment purchases and resupply orders.

This is a market where reimbursement shapes competition. Inogen’s annual filing explains that respiratory providers compete primarily on features and service because Medicare, Medicaid and private payers establish reimbursement. Access to the next referral has commercial value.

In the Respironics case, the whistleblower alleged that the manufacturer bought valuable prescribing data and gave it to suppliers to influence their product recommendations. The data helped suppliers identify physicians to approach for sales. A commercial advantage could be delivered with the data.

The government’s Vision Quest complaint describes another arrangement: commissions on braces bought by Osteo Relief clinics, with the intermediary restricting direct contact between manufacturer and clinics. It alleged that Vision Quest accepted the resulting damage to custom-brace quality:

VQ could not discuss the braces with the ORIs, and therefore could not provide instructions to the ORIs or correct poor-quality photos that were used to manufacture the custom braces. The company was willing to accept that tradeoff in order to continue to receive sales from Results and the ORIs.

United States v. Vision Quest Industries, Incorporated, government’s complaint

That allegation connects the sales arrangement to the equipment the patient received. The manufacturer, the intermediary and the clinic each held a different part of the explanation.

Osteo Relief Institutes and their owners agreed to pay more than $7.1 million over allegations involving unnecessary braces and knee injections. Vision Quest Industries settled for $2,250,000 over allegations that its kickbacks caused the clinics to bill Medicare. The government pursued both the businesses billing for the braces and the manufacturer behind them.

Brace Orders Sold as Leads

A Texas supplier owner’s criminal case shows what could arrive behind a purchased lead. In its announcement of the criminal case, the Justice Department reported from court documents that the owner paid kickbacks for signed brace orders issued without doctors examining or treating patients. The payments were described as marketing. He also concealed his control of a supplier by listing another person as its sole owner and manager on a Medicare enrollment application. He pleaded guilty to conspiracy to commit health care fraud.

The civil AZ Diabetic Supply case reached the same transaction from the supplier’s side: the company paid a fee for each brace prescription it purchased from marketing companies. The signed order was itself what the supplier was buying.

A claim can also consume a benefit the patient later needs. In the Kinex complaint, the whistleblower alleged that an earlier brace claim prevented coverage for a brace after a later procedure. The consequence reached beyond the payment on the first bill.

Catheter Cases Reach the Prescription and the Patient

The C.R. Bard settlement concerned alleged free samples and discounts encouraging urology practices to use its catheter prescription form. That puts the form itself inside the referral arrangement.

The Prometheus Group agreed to pay $550,000 to settle allegations that the company caused providers to reuse single-use catheters and single-user rectal sensors across patients. The government’s complaint described training providers to reuse catheters despite contamination concerns. Instructions to customers were part of the alleged mechanism.

What Billing Controls Caught

The Centers for Medicare & Medicaid Services’ September 2026 supplier action identified more than $3.4 billion in suspected fraudulent billing. The agency said some suppliers billed for deceased beneficiaries or equipment people never requested or received. Four suppliers had lost Original Medicare billing privileges and then billed Medicare Advantage plans. CMS barred the suppliers from future payments through the affected programs.

Separately, an Inspector General audit of inpatient-stay payments found $22.7 million in improper supplier payments. It reported that payment errors fell substantially after CMS changed system edits, but continued afterward.

What Evidence Is Needed to Report Medicare Fraud?

Altered prescriptions, billing instructions, service records and sales correspondence can connect the equipment to the government claim. Our whistleblower experts assess that connection with you and the decisions behind it. Orbit’s case turned on changes to documents. Lincare’s admissions reached the instructions given after employees questioned bills. The manufacturer’s role can appear in sales correspondence, data sharing, financing or commissions.

Healthcare employees who brought these cases worked in different parts of the business. Arriva’s whistleblower was a former call-center employee. The Lincare oxygen case began with former employees at a local service center. A supplier’s billing history becomes much more useful when someone can explain why it looked that way.

A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers. We assess the connection between your knowledge of the business and its government claims, then bring in durable medical equipment fraud whistleblower lawyers with the experience the case needs.
