AML Compliance Officers and Auditors: Can Your Work Qualify for a Whistleblower Award?

Whistleblower Justice Network

Compliance officers and auditors can qualify for anti-money laundering whistleblower awards, including for information reported as part of the job. You may know why a monitoring system misses transactions, which audit findings reached management, or who approved leaving a control problem unresolved. The Anti-Money Laundering Act expressly includes job-duty reporting. That makes the work you were hired to do a potential source of an award.

AML Compliance Officer Whistleblower Eligibility Covers Job-Duty Reports

Compliance officers and auditors can qualify under the Financial Crimes Enforcement Network’s program for Bank Secrecy Act violations and specified sanctions violations. Under the Anti-Money Laundering Act, a qualifying whistleblower voluntarily provides original information that leads to successful covered enforcement. FinCEN’s explanation of the enacted law expressly includes information provided to an employer as part of the whistleblower’s duties. An internal audit or compliance role can therefore produce qualifying information.

Original information can come from independent knowledge or independent analysis. An investigator may know what happened inside an account review. An auditor may connect testing results with management’s response. A monitoring specialist may understand why a transaction category never entered the system. Those are different ways of knowing how an institution’s controls actually worked.

The same role receives different treatment under other award programs. The Securities and Exchange Commission has different rules for information obtained through compliance or audit work. The Justice Department’s corporate pilot has its own rules.

Compliance staff outside the United States can also qualify for FinCEN awards. The law imposes no citizenship or residence requirement, and FinCEN welcomes non-U.S. sources. We assess the institution’s conduct and your work, including work as an outside auditor or consultant, against the applicable program.

What Proof Do You Need as a Whistleblower?

For an AML compliance officer or auditor, useful evidence connects the control failure to the transactions, warnings and decisions inside the business. A finding that reached management can show both what went wrong and who knew about it.

An anti-money laundering program brings together internal controls, compliance responsibility, training and independent testing. Banks must also understand and monitor their customer relationships. That puts different pieces of the account with investigators, onboarding staff, monitoring engineers, auditors and managers responsible for staffing or exceptions. An auditor’s testing and a manager’s response can explain the same failure from different positions. The same evidence question reaches money services businesses and hosted-wallet providers. What the business actually does with customer funds determines the controls and records we examine with you.

The distinction between a policy and its operation is concrete. In its civil assessment of U.S. Bank, FinCEN found that resource and alert caps impaired the bank’s AML controls and suspicious-activity reporting. A limit on alerts changes what investigators get to see. The person who understands that limit can explain something a transaction list alone cannot.

HSBC’s deferred prosecution agreement’s factual attachment supplies another example. In that criminal agreement, the bank admitted understaffing anti-money laundering work and failing to monitor large populations of affiliate transactions. The admitted facts describe a staffing freeze intended to cut costs and improve return on equity. Holding down compliance costs took priority while large flows of money went unmonitored.

These examples matter to the auditor who can connect an unresolved finding to a budget decision, and to the compliance officer who knows which activity the monitoring process leaves out. The useful account follows the decision through to its effect on the work.

What an Exchange Auditor Can See Beyond the Blockchain

A public transaction hash can show a transfer without showing which exchange customer received the internal credit or what staff knew about it. Hosted-wallet transfers recorded inside an exchange need not appear individually on the blockchain. Internal ledgers, wallet-control records, screening decisions and escalation histories can supply those missing connections.

For an exchange auditor, the public transfer and the internal record answer different questions. One shows movement between addresses. The other may identify the customer, the account treatment and the people who approved an exception. We connect those records to the conduct under review, whether the issue is money laundering controls, sanctions or a separate crypto fraud scheme.

Why the Resources Behind a Control Matter

A 2024 Wharton white paper puts the resource problem plainly:

The system will only work well if it is based on realistic assumptions about the level of resources, capacity, incentives and available information that actually exist.

Anti-Money Laundering: Opportunities for Improvement, Wharton Initiative on Financial Policy and Regulation, 2024

The paper also argues for better feedback from government to financial institutions about whether they are collecting and passing on useful information. Its point speaks directly to the work of testing a control: the policy’s existence says little about the resources or information available to operate it. An insider can help explain that difference with specific decisions and records.

What Is the Proposed Whistleblower Rule?

FinCEN’s proposed whistleblower rule, published April 1, 2026, includes a proposed 120-day exception affecting AML compliance officer and auditor eligibility. It would add a waiting condition for specified information obtained through compliance, audit and management work. The Financial Crimes Enforcement Network still describes it as a proposal on its published program page.

The proposal reaches both in-house staff and people associated with firms retained to perform audit or compliance functions. FinCEN says the proposed wait would give institutions an opportunity to address information through their own compliance systems. Its wording differs from the SEC’s exceptions for audit and compliance information.

We work through your role and reporting history with you and AML whistleblower lawyers, including which requirements are enacted and which remain proposed.

Can an Internal Auditor Qualify for an SEC Whistleblower Award?

An internal auditor can qualify for an SEC whistleblower award when the information concerns a securities-law violation and meets the program’s requirements.

The Securities and Exchange Commission’s whistleblower rules generally exclude information obtained through specified compliance and internal audit responsibilities, but provide exceptions. How you acquired the information matters alongside your position.

The Commodity Futures Trading Commission’s program addresses violations of the Commodity Exchange Act and has its own treatment of information obtained through audit and compliance work. An exchange’s internal records may raise questions under more than one program. We assess those connections together.

What Is the DOJ Whistleblower Program?

The Department of Justice Corporate Whistleblower Awards Pilot Program is a separate, discretionary award program that includes specified financial-institution misconduct, money laundering and AML compliance violations. Its award base is qualifying net forfeiture proceeds, which differs from FinCEN’s award base.

Under the Justice Department guidance revised July 30, 2026, information learned through compliance or internal audit duties generally needs an exception to qualify for an award.

The revision changed another important point: eligibility for another whistleblower program no longer automatically excludes a person from the pilot. The policy instead restricts duplicate awards for the same or substantially the same misconduct. That makes the relationship between the programs part of evaluating a case.

A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers. That is a separate program for fraud against the government.

Turning What You Know Into Evidence

We work through suspicious activity report confidentiality and lawful access with you and AML whistleblower lawyers. We address those questions alongside what you know about the conduct and which records explain it.

Your account of a monitoring decision, an unresolved audit finding or an escalation can identify what investigators need to examine. The evidence assessment distinguishes personal knowledge, analysis and information from other people, as well as records already held and records located elsewhere.

Your Role, Your Award and Your Job

Award eligibility, your own role in the conduct and employment protection are separate questions we handle with you. A compliance officer who raised an issue and a manager who approved the relevant decision bring different accounts of what happened.

What Is the Reward of a Whistleblower in Money Laundering?

The FinCEN framework provides aggregate awards of 10% to 30% of qualifying monetary sanctions actually collected, following covered enforcement that results in sanctions exceeding $1 million. The aggregate share covers all qualifying whistleblowers in the action.

What supports a FinCEN award depends on qualifying collections, not the size of the announcement. We assess the potential award against the enforcement and the information you can contribute.

The AML Whistleblower Improvement Act expanded sanctions coverage and created a dedicated fund in 2022. FinCEN’s published program page says it accepts information and will begin processing and paying awards after final regulations.
