Proving Actual Production in an Origin-Fraud Inquiry: What Did the Factory Really Make?

Whistleblower Justice Network

Country of origin fraud production evidence connects the goods imported to what the claimed factory actually made. The certificate gives a conclusion. A country of origin fraud inquiry follows the work behind it: the materials, the process and the output during the period those goods were made. Someone who knows the plant can explain what happened inside it. A shipping route through another country cannot supply that answer.

An importer that knowingly uses a false origin to avoid duty keeps money owed to taxpayers. An honest competitor that paid the duty has to compete without that saving. A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers.

Which Country of Origin Determination Rules Apply?

Country of origin determination rules depend on the claim being made. The origin marked on a product, eligibility for a free-trade preference and coverage under an antidumping or countervailing duty order can ask different questions about the same production. We identify the claim and the applicable rule with you before weighing the factory records.

What Is the Difference Between Preferential and Non-Preferential Origin?

Preferential origin decides whether the goods qualify for a trade agreement’s reduced duty. Non-preferential origin answers other questions, including what country belongs on the label. When marking origin differs from preferential duty origin, we trace each claim back to the factory’s work. A preference that depends on regional value content reaches into the producer’s bill of materials and costs, not just the country printed on a certificate.

Substantial Transformation Has No Fixed Value Added Percentage

For marking, U.S. Customs and Border Protection describes substantial transformation as processing that creates a new article with a different name, character and use. There is no fixed value added percentage or number of operations that settles that test. The question is what the processing made of the incoming materials.

A new label or a new box does not make Chinese goods Taiwanese. Textiles and apparel have separate origin rules.

For Tariff Classification, What Is the Country of Origin Determined By?

Where tariff-shift origin rules apply, the answer depends on whether the foreign materials underwent the required change in tariff classification during production. The classifications of the inputs and finished product under the Harmonized Tariff Schedule connect the rule to the factory’s work. A description of final assembly alone leaves the incoming materials unexplained.

Assembly in another country can also fall within an antidumping or countervailing duty order through the rules on scope and circumvention. For assembly inquiries, the Department of Commerce considers investment, research and development, the production process, the extent of the facilities and the value of the processing.

The Factory and the Shipment Have to Share a Timeline

The production history has to cover the goods and period behind the origin claim. The distinction is concrete in the complaint against Ceratizit USA, which alleged that Chinese tungsten carbide rods were shipped through Taiwan and falsely declared Taiwanese.

The whistleblower alleged that sea shipments had originated in Xiamen, China, through October 5, 2018. Starting with a shipment arriving on October 24, 2018, almost all originated in Taiwan. That allegation gives the inquiry a point of comparison: what changed in production when the route changed?

Equipment history belongs to the same comparison. If a machine was installed after the shipments left, it cannot explain how those goods were made. We connect what you know about the plant to the production period, rather than letting a description of today’s factory stand in for the factory that supplied those imports.

How to Prove Country of Origin?

Country of origin is proven by connecting what a factory bought, used and made to the goods imported, under the rule that applies to those goods. An origin certificate unsupported by factory production records leaves that connection open. We examine the materials, purchases, equipment, process records and finished product with you.

For a preference claim involving regional value content, the bill of materials and production costs explain the inputs behind the claimed result. For an assembly inquiry, the facilities and production process address the work performed there.

We compare the supplier invoice and payment with what was declared, and the actual manufacturer with the duty treatment claimed. The Importer Security Filing for ocean cargo gives us an earlier declaration of the manufacturer or supplier, country of origin and container-stuffing location. Those details help connect the claimed producer to the goods that entered the country.

The case against Evolutions Flooring ended in an $8.1 million settlement over allegations of false manufacturer and origin information for Chinese multilayered wood flooring. A whistleblower company brought the case, and the government joined it for settlement. In its settlement announcement, the Department of Justice described Customs visiting factories in Thailand, having flooring specialists review identified shipments, analyzing import records and interviewing witnesses.

Could the Factory Have Made That Much?

Factory capacity evidence tests a false origin customs allegation against the volume the claimed producer could make. The Ceratizit complaint put that question directly:

CB-Ceratizit does not have sufficient manufacturing capabilities in Taiwan to make the volume of rods that have been imported into the United States.

Whistleblower’s complaint, United States ex rel. Mark Alan Stover v. Ceratizit USA, Inc.

The complaint also alleged that Taiwan lacked sufficient raw materials for that volume and had not imported the necessary materials. The allegation connected the claimed output to both manufacturing capability and incoming supply. That is a more useful question than whether a supplier can produce an origin certificate: where did the capacity and materials for these shipments come from?

DOJ’s Ceratizit settlement announcement reported a $54.4 million settlement over allegations involving false origin, wrong tariff classification and unmarked imports. The whistleblower’s announced award was approximately $9.75 million. The factory question was part of a case about several ways duties allegedly went unpaid.

What Evidence Is Needed to Prove Fraud?

Proving country of origin fraud connects production evidence about the goods to what the company knew and what it did next. Internal messages, warnings and declarations left uncorrected can show that knowledge.

The complaint against Grosfillex illustrates that connection in a furniture-parts case. It alleged that barstool bases and backs would enter as kits, then be separated and paired with different parts. The complaint quoted an engineering manager’s message about how to present the imports:

We are also trying to avoid to show anything that could indicate we are buying separate components. The less info is visible, the best [sic] it is. We are buying kits: not seats and backs.

Engineering manager’s message quoted in the complaint, United States of America ex rel. Edward Wisner v. Grosfillex, Inc.

The company allegedly planned to hide what it was really buying. Grosfillex agreed to pay $4.9 million to resolve the allegations. The government’s settlement announcement also described allegations that earlier declarations remained uncorrected after Grosfillex learned they were false. What happened after the business learned about the problem belongs beside what it originally declared.

Public Shipping Records Lead Back to the Producer

Public shipping records can identify the shipper, cargo, ports and stated origin. The production question still requires evidence about the actual producer. Even a manufacturer identifier deserves a closer look.

A 2020 working paper from the U.S. Census Bureau’s Center for Economic Studies, Are Customs Records Consistent Across Countries? Evidence from the U.S. and Colombia, compared the countries’ customs records. It found that manufacturer identifiers in the U.S. data implied roughly twice as many Colombian exporters as appeared in Colombia’s records.

For an origin inquiry, the implication is practical: we need the business behind the code, then the production behind the business.

National trade totals also rely on declared origin: Census’s trade methodology uses the shipment country when origin cannot be determined.

For goods under an antidumping or countervailing duty order, Commerce’s ACCESS docket holds public documents and public versions from the proceeding. We connect the order and producer information to what you know happened inside the plant.

Country of Origin Mislabeling Has Its Own Evidence

Country of origin mislabeling leaves evidence on the goods and their packaging. In the Ceratizit complaint, the whistleblower alleged that test purchases arrived with no origin marking on the rods or their packaging. That was a separate allegation alongside the Taiwan production claim.

Customs generally requires the English country name to reach the ultimate purchaser, usually the last person in the United States to receive the article in its imported form. Its marking guidance requires a mark that is legible, visible during ordinary handling and as permanent as the product permits.

What Sourcing Staff and Competitors Can Show

A whistleblower in sourcing may know the materials purchased and the supplier’s actual operation. Production staff may know the process, equipment and work performed. A broker or logistics employee may know the declarations and route, an accountant the invoices and payments, and a competitor the product sold against theirs.

We relate your firsthand knowledge to the product, factory and period, then test it against the origin claim and the duty avoided. You do not need copies of the logs or the importer’s customs entries to call us: what you saw is where we start.
