California Virtual Academy Attendance False Claims: The Records Behind the State Settlement

Whistleblower Justice Network

K12 Inc. agreed to pay $2.5 million to California’s attorney general to settle false claims allegations that California Virtual Academy obtained inflated attendance-based state funding. The investigation followed attendance tracking, reporting and the forms used to determine that funding. If you worked with those records, you may know where the attendance reported for payment stopped matching what the school recorded.

This page follows the California agreement, the schools it covered and the payments it required. The broader education fraud cases show other ways school records reach public money, including tutoring invoices and federal student-aid claims. Here, the connection was attendance reported for state funding.

Which California Virtual Academy Records Were at the Center?

Attendance tracking, attendance reports and state funding-determination forms were at the center of the California investigation. The former employee’s case alleged inflated claims for that funding. If you worked with the records, the comparison runs from what the school recorded to what the state was told. In the employee’s allegation, the attendance record had become a claim on taxpayers.

The funding form gives the attendance entry its financial significance. We examine how the information traveled: which school it concerned, who prepared the report, who supplied the attendance information and what funding the submission supported. An employee who knows the source records may explain a discrepancy that the final form conceals. An employee who knows the reporting process may explain how that discrepancy reached the state. In publicly funded tutoring, TestQuest admitted in its civil settlement stipulation that false attendance records generated invoices paid with federal funds.

Who Was the Operator in the California Virtual Academy Case?

The California case named California Virtual Academy @ Los Angeles and K12 Inc., doing business as Delaware K12 Inc. The agreement covered K12 and a specified group of California Virtual Academies and other schools.

The agreement’s school schedule included California Virtual Academies in places such as Fresno, Los Angeles and San Diego, along with Insight schools and iQ Academy Los Angeles. An insider’s knowledge belongs to a particular school in that group. We connect that school’s attendance information to the reporting responsibility and state funding at issue.

If you worked across several schools, you may recognize a shared reporting process behind different school names. We follow your school’s attendance information to the organization that submitted it for funding. The California agreement covered both K12 and the listed schools.

What Did the California Agreement Resolve?

The July 2016 agreement addressed attendance-funding allegations and a former employee’s separate employment claims. The former employee brought the California False Claims Act case in Los Angeles County Superior Court. California’s attorney general investigated the attendance records, funding-determination forms and reporting, then moved to join the case for settlement.

What Payments Did the California Virtual Academy Agreement Require?

K12’s payment commitment to the attorney general resolved the state funding dispute. The agreement separately provided $30,000 for the whistleblower’s fees and costs and $50,000 for employment-related claims. It assigned the whistleblower’s share of the government’s recovery to a separate resolution between the attorney general and the whistleblower.

The agreement treated compensation for employment claims, fees and costs, and a share of the government recovery as distinct payments. We work through employment concerns and the funding evidence with you and education fraud whistleblower lawyers.

A whistleblower case under the False Claims Act can pay 15% to 30% of what the government recovers. That is the federal range. California Virtual Academy’s state-law agreement reserved its whistleblower share separately, and we assess the applicable reward route with you based on the public funding involved.

Can State School Funding Support a Whistleblower Case?

State school funding supported the former employee’s California False Claims Act case over California Virtual Academy’s attendance claims. The agreement connected the school records to the requests for state money.

A California Supreme Court decision concerning One2One Learning Foundation illustrates why. Students and parents alleged failures to provide promised distance-learning services and the use of attendance forms to obtain public education funding. In its 2006 decision, the court held that the charter-school corporations and operators at issue could face claims under California’s False Claims Act, while public school districts could not.

For an insider, the relevant knowledge may span the school whose attendance was recorded and the company responsible for the reporting. We examine those roles with you and bring in whistleblower lawyers who know California public-funding cases. Your experience with the actual operation helps connect the names on the documents to the decisions behind them.

What Would an Attendance-Funding Insider Compare?

We compare the underlying attendance information, the report drawn from it, the funding-determination form and the state payment it supported. The connection between school records and public payments gives the account its substance. Your knowledge may concern the original entry, a later change or the person responsible for the submission. A changed report raises questions about who changed it, the explanation given and any warnings about inaccurate information. We connect your knowledge of those decisions to the particular school and its request for public money.
